General Terms and Conditions
- Satisfaction Guarantee: RCN will refund or credit the monthly recurring
service charge only; customer will be responsible for installation charges, usage
fees (such as Pay-Per-View) and applicable recurring charges. Refunds or credits
are contingent upon complete disconnect from an eligible RCN service package within
30 days from date of install and return of all RCN-owned and provided equipment in
satisfactory working condition.
- Services Provided. RCN will provide local telephone, and/or long-distance
telephone services as defined in the respective RCN tariffs and/or web-based agreements
(the “Services”). RCN tariffs and other terms and conditions of service are on file with
the appropriate federal and/or state regulatory agencies. In the event a question arises
requiring an interpretation of these terms of service, the provisions found in the tariffs
or web-based agreement will take precedence. RCN will also provide cable television/video
and Internet services. These offerings shall also be included in the defined term “Services”
and their terms and conditions shall be determined in accordance with the applicable tariff
and/or this Sales Order Form.
- Charges For Services. Customer shall pay for RCN Services in accordance with the
rates provided under RCN’s tariffs and/or web-based agreement. RCN will invoice customers for
telephone service one (1) month in arrears for usage and one (1) month in advance for all
monthly recurring charges. Cable television services are billed one (1) month in advance.
RCN’s Internet Service will be charged monthly to the customer’s predetermined credit card or
invoiced (cable modem access customers only) one (1) month in advance, unless otherwise agreed
to by RCN. Invoices shall become due and payable upon receipt. Any invoices not paid within
thirty (30) days following the date of the invoice shall be deemed past due and assessed a
finance charge in the amount of one and one half percent (1.5%) of the outstanding balance or
such lesser maximum charge as permitted by applicable law. Customer agrees to pay RCN any and
all costs and expenses (including reasonable attorney’s fees) associated with the collection of
any amounts due from the customer. If in the future a portion of the package is canceled
(voluntarily or due to non-payment), remaining service charges will revert to a la carte
rates.
- Credit Check. RCN reserves the right to verify credit as a condition of providing all
or any component of the Services. Credit card verification and validation are required for all
prospective RCN Internet service customers (excluding cable modem customers who wish to be
invoiced monthly for services)
- RCN Property. All equipment, including, but not limited to, cables, wires, amplifiers,
cable modems, converters and remotes delivered to and/or installed in the Customer’s home by RCN
(“Equipment”) remains the property of RCN. Customer must return all equipment immediately upon
termination of service. Failure to return the Equipment will result in a charge to be determined
with reference to RCN’s then current charges for the same, which amount shall be due and payable
immediately. Customer agrees to pay such charges whether the Equipment is lost (through theft or
otherwise) or destroyed. In the case of a converter, Customer shall also pay the cost to RCN of
misuse of the converter(s) by third parties arising out of Customer’s loss of control over same.
Any collateral form of payment Customer provides to RCN will be used to cover any and all equipment
charges. If customer pays an equipment fee, RCN will rebate the fee upon satisfactory return of
all equipment on customer account within 30 days of disconnect.
- Unlawful Internet Intentions. RCN’s Internet service shall only be used for lawful
purposes. The RCN Internet account holder is responsible for all use and misuse, with or without
knowledge or consent, of the account. The account holder agrees not to use the account for any
illegal activities, as defined in the RCN Internet Access Agreement.
- General Provisions. (a) The customer understands that unauthorized reception of cable
television services is illegal and punishable under State/Federal Law. (b) RCN is not responsible
for poor reception or damage caused by equipment not installed by RCN. (c) The customer understands
that cable installation may be done by an independent contractor and that due to adverse weather or
technical complications, the installation may have to be rescheduled. RCN is not liable if the
installation date has to be changed. (d) Cable converter boxes are restricted for use at the residence
indicated on the front of this form. (e) The customer’s selection of RCN telephone will apply to the
telephone number(s) listed on the reverse side and any number(s) associated with the main telephone
number. (f) Only one (1) local, one (1) regional (where applicable) and one (1) long-distance company
may be designated for each number listed on the reverse side. (g) RCN’s Internet service includes
access to discussion groups and chat groups which may contain language or images that are intended
for adults only. Customers under the age of 18 must have parental or legal guardianship approval to
join RCN’s Internet service. RCN is not responsible for any minor viewing inappropriate adult
materials. (h) RCN is not responsible for and exercises no control whatsoever over the content of
information passing through its Internet service or stored on its systems, regardless of origin.
Access to other networks through RCN’s Internet service must comply with the rules appropriate for
that network. (i) Use of any information, programs or data obtained from RCN’s Internet service is
at the customer’s own risk. RCN specifically denies any responsibility for the accuracy or quality
of information obtained from or through RCN’s Internet service. (j) Transmission of any Internet
material in violation of any US or State regulation is prohibited. Copyrighted material may not be
uploaded without the permission of the copyright holder. (k) RCN makes no warranties of any kind,
whether express or implied, for the Internet service it is providing. RCN disclaims any warranty of
merchantability or fitness for particular purpose with respect to all services. (l) The customer is
responsible for canceling promotional offers at the end of the term or the monthly prevailing rate
will take effect. (m) The customer is responsible for calling RCN customer service at 1-800-RING-RCN
to cancel any and all services.
- Violation of Terms and Conditions. A violation of any part of the above mentioned terms and conditions may result in any one or more of the following: (a) verbal or written notification; (b) cancellation or suspension of your account(s); (c) disconnection; (d) monetary charges; or (e) legal action. Other terms and conditions may apply. See applicable tariff for details.
- VoIP 911 Dialing. Under certain circumstances, RCN’s Voice-Over-Internet-Protocol (“VoIP”) service (where available) will not support Traditional 911 or Enhanced 911 (E911) dialing access to emergency services. The address associated with an E911 call on RCN’s VoIP service is specifiec to the Customer’s original service location only. Movement of the VoIP equipment from the original service location to a new service location may result in a mistaken idenitification of the E911 call as having com from the original location. Furthermore, 911 dialing on RCN’s VoIP service will not function in the event of a power failure or improper network connection and/or function. Customer understands and acknowledges that RCN, its affiliates, subsidiaries, parent companies and network service providers, will have no liability whatsoever with respect to 911 dialing on RCN’s VoIP service.
- Internet Online Agreement. The customer agrees to abide by the terms and conditions of the RCN Internet Access agreement and any addendums to it, detailed on the RCN home page (http://www.rcn.com).
- Internet Local Access Number. RCN will not be responsible for any telephone charges incurred while using the Internet. Customers are responsible for verifying that their access number is a local telephone call.RCN’s Unlimited Long Distance Plan allows unlimited minutes of direct-dialed 1+ domestic calling for residential voice service only. If usage is not consistent with residential voice applications (included but not limited to Internet/data use, facsimile, auto-dialing, resale, telemarketing or other non-residential usage) RCN may immediately suspend, restrict or cancel the customer’s service and assess additional charges for usage in excess of 5,000 minutes per month. Please be advised, customers checking email, surfing the Internet or sending faxes should not incur an additional monthly fee for minute usage due to the brevity of these applications.
High-Speed Internet
Speed comparisons are for downloads only and are compared to 768Kbps
DSL and 56Kbps dial-up. Maximum download speed 1.5, 5, 10, 20 Mbps and uploads of 384Kbps,
800Kbps, and 2Mbps vary depending on the products that is selected. Actual speeds may vary
and are not guaranteed. Many factors affect download speed. A reimbursable equipment fee may
be required to receive an RCN cable modem or converter. A fully configured 10 Base-T Ethernet
card must be installed in subscriber’s computer prior to the installation of the cable modem.

- Add-Ons: RCN Music requires an approved MP3 music player. The

- Contract Terms for 1.5 Mbps High-Speed Internet Package: 12-month service contract
is required. If service is
cancelled between months 2-12, a $75 early termination fee applies. $16.95 per month rate is
valid for 12 months; regular retail rates apply thereafter. Other restrictions apply. Not all
services are available in all areas.
Cable TV
Not all channels available in all areas. Pricing, programming, channel
location and packaging may change. Some ON DEMAND selections may be subject to charge indicated
at time of purchase. Free ON DEMAND programming is limited. Network and Premium ON DEMAND
programming require subscription to underlying network or premium channel. ON DEMAND and Music
Choice programs cannot be recorded with DVR. Digital converter box for each television is
required to receive DigitalVision, Video ON DEMAND, and Pay-Per-View. One digital converter
box is included with package. Additional converter boxes are $5.95 each. DigitalVisions
subscription includes Showtime®, The Movie Channel™, CineMax®, Starz!®, and Encore®. The

- Equipment: To receive HD features and benefits, an HD television
(not provided) converter, remote control and other equipment is required. Advertised
channels/stations generally provide a mix of HD and non-HD programming. HD programming is limited
to the programming provided to RCN in HDTV format by the programming provider. DVR recording time
is limited. DVR equipment/converter is not compatible with all television sets. The customer is
financially responsible for any damages to, or misuse of, any equipment, or for the failure to
return any equipment if service is terminated. The availability of services, pricing and offerings

- Contract Terms for Unlimited Phone Package: 12-month service contract is required.

restrictions apply. Not all services are available in all areas. Calls to other foreign
countries will be billed on a per-minute basis. RCN does not provide Caller ID equipment.
Additional charges apply to new or moved phone jacks and may apply to additional cable

Installation and Equipment Fees
- Phone Installation: Includes technician labor, materials, and
installation of pre-wired jacks in good working condition. Additional new jack installations,
jack relocations, custom installations, or repair work will incur additional charges.
- Cable TV Installation: Includes technician labor, materials,
converter box installations, and the installation of up to five pre-wired (existing and working)
outlets. Additional new jack installations, jack relocations, custom installations, or repair
work will incur additional charges.
- High-Speed Internet Installation: Includes technician labor,
materials, and cable modem installation. If your PC requires a NIC or PCMCIA card, the
technician will install the card for the appropriate fee (PC Network Card: $50.00, PCMCIA
Card: $79.95). Custom installations, or repair work will incur additional charges.
- One-time Refundable Equipment Fee : Customers with RCN
equipment (converter box or cable modems) will be charged a one-time $50.00 equipment fee.
This charge will appear on the first bill, and is refunded upon satisfactory return of any
equipment within 30 days of disconnection. If the equipment is returned after the 30 days,
the fee is nonrefundable.
